California and Berkeley Collaborative Law Attorney
As a family law attorney with more than 25 years of experience, I have concluded that people make their best choices regarding divorce when they resolve conflict through negotiation. This lowers tensions and affords those involved greater control over the outcome. It also provides the basis for a new kind of relationship, particularly when children are involved, or a graceful exit from a marriage. In addition, cooperative approaches are less financially and emotionally draining than litigation.
Traditional litigation can increase distrust and reduce the sense of control over the legal outcome. It is often costly and time-consuming.
Mediation and collaboration are two cooperative approaches to family law issues. They enable couples, with the assistance of legal representation, to negotiate resolutions to troublesome issues in divorce or custody matters, or to develop pre- or postnuptial agreements.
In mediation, couples work with a trained lawyer facilitator to resolve divorce issues. The agreements are then submitted to the court for final approval.
These approaches can be used to resolve a variety of family law matters, including:
- Divorce and dissolution of marriage
- Child custody and modifications
- Child support and modifications
- Spousal support and modifications
- Property division
- Marital settlement agreements
- Prenuptial and postnuptial agreements
